If you are considering filing for bankruptcy protection, whether you have hired an attorney or not, you can start to gather all the documentation that will be required during the process. Here’s a list of the items you want to compile:
- A detailed list of all personal property you currently own—This entails everything, including cash, investments, retirement funds (though generally exempt from attachment), savings or checking accounts, motor vehicles, household goods, electronics, jewelry, recreational equipment, money owed to you, interest in insurance policies, royalties or similar fees
- A complete list of all real property you own, documenting your interest, the fair market value of the property, and any debts, liens or encumbrances on the property
- A list of all your creditors, showing how much you owe each creditor, what your monthly payments are, whether the obligation is secured, and what security is pledged
- The names and addresses of anyone who is jointly liable (a co-debtor) on any obligation you owe
- Any current leases where you are landlord or tenant
- Employment information, including name and address, how long you have been with your current employer, your job, and all income you receive from your employment
- Documentation for any other source of income, including spousal support or alimony
- A list of all payments made to creditors within the last 90 days (the bankruptcy court may require that some or all of these payments be returned and placed in the bankruptcy estate, and that your creditors join the bankruptcy proceeding
- A list of all payments made to family members or others of close relationship during the last year
- Documentation of any lawsuits or legal proceedings filed against you in the last year
- A list of any gifts or charitable donations you made in the last year
- A list of all property you transferred to another person during the last two years
- A list of all property seized by or assigned to creditors in the last 120 days
- The name, location and nature of any business in which you owned an interest during the last six years
